1          Introduction

1.1       To the extent there is any inconsistency between these Terms and Conditions and any other reference to the promotion, these Terms and Conditions will prevail. If you participate in this promotion then you are deemed to have accepted and agreed to these Terms and Conditions. If you do not wish to participate in this promotion, please advise our showroom staff at the time of your transaction.

1.2       This Win Back Your Purchase Promotional Lottery (Promotion) is conducted by King Furniture Australia Pty. Ltd (ABN 79 002 757 333) trading as King Living (King Living) of 123 Turrella Street, Turrella, NSW 2205 (the Promoter).

1.3.      Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

 

2          How to enter

2.1       The promotion commences at 9:00am AEST on Saturday, 15 June 2024 and ends at 06:00pm AEST on Sunday 30th June 2024.

2.2       To enter, individuals must visit any showroom in Australia or the Australian website (https://www.kingliving.com.au/) from the 15-30 June 2024 and enter into a binding transaction to purchase a King Living product (Sales Order).

2.3       Entry is only open to Australian residents aged 18 years or over, however entry is not open to residents of any Australian state where a permit  to run this Promotion is required and has not been granted.

2.4       Only one (1) entry is permitted per person.

2.5       The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, at its sole discretion, to disqualify any entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of the Promoter’s rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

 

3          Prize

3.1       The winner of the trade promotion will receive the value of their purchase, up to a maximum of  $5,000, in the form of a refund. For the avoidance of doubt:

  1. If the total value of the winner’s purchase (as shown on the winning Sales Order) equals or exceeds $5,000, the amount of $5,000 will be refunded, but the balance of the total order value, as shown on that Sales Order which exceeds $5,000 will not be refunded;
  2. If the total value of the winner’s purchase (as shown on the winning Sales Order) is less than $5,000, the total order value, as shown on that Sales Order, will be refunded and the remaining balance of the $5,000 prize value voided.

3.3       Total prize pool value is $5,000 (or less if the value of the winner’s transaction is less than $5,000) including GST.

3.4       The prize is not transferable or exchangeable.

3.5       Only one (1) Sales Order will be randomly selected.

3.6       The draw for the promotion will take place at 5:00pm AEST on Tuesday 2nd July, 2024. The draw will be conducted by a responsible employee of the Promoter, on behalf of the Promoter. The first valid entry as drawn by the Promoter will be the winner of the prize.

 

4          Winner

4.1       If there is a dispute as to the eligibility or identity of an entrant or the validity of an entry, the Promoter reserves the right, at its sole discretion, to determine the outcome of that dispute.

4.2       One (1) Sales Orders will be randomly selected as the winning entry.

The Promoter may draw additional reserve entries, and record them in order, in case of an invalid entry or ineligible entrant. If the prize remains unclaimed as at 5:00pm AEST on Thursday 4th July 2024, the prize will be awarded to the first valid reserve entry.

4.3       The winner will be notified via email/telephone (using the contact details provided in conjunction with the entrant’s Sales Order) on or before 9:00am AEST on Wednesday 3rd July 2024. The winners’ details (last names, first initials and postcodes) will be published on the King Living website within 30 days of the draw or redraw if applicable.

4.4       This Promotion is a game of chance.

4.5       The Promoter’s decision is final and no correspondence will be entered into.

4.6       The Promoter is not liable for a winner who cannot be contacted in accordance with these Terms and Conditions.

4.7       As a condition of accepting a prize, the winner must, if requested, sign any legal documentation in the form required by the Promoter in their absolute discretion, including but not limited to a legal release and indemnity form.

4.8       By entering the Promotion, entrants acknowledge and agree that, if they are a winner, their name and/or image may be featured on the King Living website and any other online platform (including social media platforms) solely in connection with the Promotion.

 

5          General

5.1       Instagram, Facebook and/or other social media platforms may be used to advertise or promote the Promotion. However, entrants acknowledge that the Promotion is in no way sponsored, endorsed, administered by, or associated with, those platforms.

5.2       If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, at its sole discretion, to the fullest extent permitted by law:

  1. to disqualify any entrant; or
  2. to modify, suspend, terminate or cancel the promotion.

5.3       Nothing in these Terms limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Australian Consumer Law, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) excludes all liability (including for negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion including (without limitation) loss in connection with:

  1. theft, unauthorised access or third party interference;
  2. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
  3. any variation in prize value to that stated in these Terms and Conditions;
  4. any tax liability incurred by a winner or an entrant; or
  5. use of the prize.

5.4       The Promoter reserves its rights to recover damages or other compensation from any person who breaches these Terms.

5.5       To the maximum extent permitted by law, each entrant indemnifies, and must defend and hold harmless, the Promoter and each of their employees, servants, agents and contractors, from and against all losses arising from:

  1. a breach by the entrant of any of these Terms;
  2. any third party claim arising directly or indirectly from a breach by the entrant of any of these Terms;
  3. any negligent, wilful or otherwise wrongful act or omission of the entrant;
  4. any fraudulent or dishonest acts or omissions by the entrant;
  5. any breach by the entrant of any applicable Laws; and
  6. any claim by any third party (including individuals, legal entities and governmental departments or agencies) arising directly or indirectly as a result of the entrant entering the Promotion.

5.6       These Terms are governed by the laws of the State of New South Wales.

5.7       All monetary amounts referred to in these Terms are in Australian dollars and are inclusive of GST.

 

6          Privacy

6.1       The Promoter collects personal information (PI) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.kingliving.com.au/privacy-policy/.

6.2       The Promoter may contact the entrant in the future with information about the Promoter, including special offers, market research or to provide the entrant with marketing materials via any medium including mail, telephone and commercial electronic messages or any other form of emerging, digital or conventional communications channel whether existing now or in the future. By entering the Promotion, entrants acknowledge and agree that the Promoter may use their PI in the manner set out in this clause.

1.  Introduction

 

1.1 This King Trade Win Back Your Purchase Trade Promotion Lottery (Promotion) is conducted by King Furniture Australia Pty. Ltd trading as King Living (the Promoter) (King Living) of 123 Turrella Street, Turrella, NSW 2205 (ABN 79 002 757 333, ACN 002 757 333).

 

1.2 To the extent there is any inconsistency between these Terms and Conditions (Terms) and any other reference to the promotion, these Terms will prevail.

 

1.3 For the purposes of these Terms a:

  1. Account Holder means the person noted in King Living’s records who is authorised to operate the King Trade Account;
  2. KingTrade means the trade and commercial division of King Living;
  3. KingTrade Account means an approved and registered trade account with King Trade; and
  4. Trade Purchase means a purchase of products from King Living authorised by by an Account Holder and which is subject to King Living’s Trade Clients Terms and Conditions of Sale.

 

1.4 If you participate in this Promotion then you are deemed to have accepted and agreed to these Terms.

 

1.5 The Promotion commences at 9.00am AEST on Saturday 1 June 2024 and ends 06:00pm AEST on Sunday 30 June 2024 (Promotion Period).

 

1.6 The Promoter reserves the right to, at its discretion:

  1. cancel, suspend or restart the Promotion for any reason; and/or
  2. disqualify any individual who has breached these Terms or otherwise interfered with the proper conduct of the Promotion.

 

2.  Eligibility

 

2.1 Subject to this clause, the Promotion is open to entry by any organisation that is a current King Trade Account domiciled in Australia.

 

2.2 Employees of the Promoter (and their immediate family), participating retailers and agencies associated with this Promotion are ineligible to enter. 3.1 To enter, a current King Trade Account holder must make a Trade Purchase with King Living in a King Living showroom in Australia and enter into a binding transaction to purchase a King Living product (Sales Order) during the Promotion Period.

 

3.2 Each Trade Purchase transaction during the Promotion Period, up to a limit of one entry per King Trade Account, will be automatically entered into the Promotion, unless the Account Holder advises King Living’s showroom staff at the time of the Trade Purchase that they do not wish to participate.

 

3.3 Only one (1) entry is permitted per King Trade Account.

 

4.  Winners

 

4.1 This Promotion is a game of chance.

 

4.2 The draw for the Promotion will take place at 5:00pm AEST on Tuesday 2nd July 2024 at 123 Turella Street, Turella NSW 2205 Australia. The draw will be conducted by a responsible employee of the Promoter, on behalf of the Promoter.

 

4.3 Four (4) Sales Orders will be randomly selected as the winning entries.

4.8 If any prize remains unclaimed as at 5:00pm AEST on Wednesday 17 July 2024, then the Promoter will conduct a re-draw on Thursday 18 July 2024 at 123 Turella Street, Turella NSW 2205 and will notify winners in writing by Friday 19 July 2024. Any winners arising from the re-draw must claim their prize by email to [email protected] by 5.00pm AEST Thursday 1 August 2024.

 

4.9 If any prizes remain unclaimed within 3 business days of the re-draw, they will be forfeited.

 

4.10 The winners’ details (last names, first initials and postcodes) will be published on the King Living website www.kingliving.com.au within 30 days of the draw or redraw if applicable.

 

4.11 The Promoter’s decision is final and no correspondence will be entered into.

 

4.12 The Promoter will make reasonable efforts to contact the winners, but is not liable for a winner who cannot be contacted in accordance with these Terms.

For the avoidance of doubt:

  1. If the total value of the winner’s purchase (as shown on the winning Sales Order) exceeds $5,000 (inc GST), the amount of $5,000 (inc GST) will be refunded or credited; and
  2. If the total value of the winner’s purchase (as shown on the winning Sales Order) is less than $5,000 (inc GST), only the total order value inclusive of GST, as shown on that Sales Order, will be refunded or credited and there will be no further prize awarded.

 

5.2 The total prize pool value is up to $20,000 (inc GST) (or less if the value of any of the winner’s transactions are less than $5,000 (inc GST)).

 

5.3 The prize is not transferable or exchangeable, cannot be varied or taken as cash and cannot be used or redeemed in conjunction with any other offer by the Promoter.

 

5.4 A refund can only be made to the King Trade Account nominated bank account and a credit can only be allocated to the King Trade Account that made the Sales Order.

 

5.5 The credits to the King Trade Account for future purchases or refunds to the King Trade Account nominated bank account will be made within 28 days of the date of the draw or re-draw if applicable.

 

6.  General

6.3 The Promoter reserves the right to:

  1. amend these Terms; and
